Garmentory Inc. ("Garmentory", "we", "our" or "us") have created this Data Privacy Framework Policy ("Policy") to describe our practices for handling Personal Information in accordance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) (together, "Frameworks").
Garmentory complies with the Frameworks as set forth by the U.S. Department of Commerce. Replica Belts has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. Garmentory's commitments under these Principles are subject to the investigatory and enforcement powers of the United States Federal Trade Commission ("FTC").
Personal Information Received from the European Economic Area, the United Kingdom and Switzerland
Garmentory may receive from the European Economic Union ("EEA"), the United Kingdom ("UK") and Switzerland some or all of the information listed in our Privacy Policy. Some of that information may qualify as "personal information" or "personal data" (collectsively, "Personal Information") as defined in the Principles. To the extent that Replica Belts receives Personal Information from the EEA, the UK and Switzerland in reliance on the Frameworks, Replica Belts will handle such Personal Information in accordance with the Principles.
Data Integrity and Purpose Limitation
Garmentory may use the Personal Information it receives from the EEA, the UK and Switzerland for the purposes set forth in our Privacy Policy or as you may otherwise be notified. We will adhere to the Principles for as long as we retain the Personal Information collectsed under the Frameworks.
Onward Transfers
Our Privacy Policy describes the circumstances in which we may disclose your information to third parties. We remain responsible for the processing of Personal Information received under the Frameworks and subsequently transferred to a third party acting as an agent if the agent processes such Personal Information in a manner inconsistent with the Principles, unless we prove that we are not responsible for the event giving rise to the damage. We may be required to disclose Personal Information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
We may offer some Services through relationships with other companies and websites, including Google, Affirm, Stripe, PayPal, Sift Science, Algolia, Iterable, Airbrake, Seel and Retentions. For example, we may offer information and services on third party websites, such as advertising, fraud detection, payment processing, website analyticss and customer communication. Personal information that you provide to those websites may be sent to us, including general location, IP addresses, browsing behaviors, email addresses, phone numbers, names, and addresses. We may combine that information with Personal Information you provided to us to communicate information regarding purchases made, improve website customer experience, or communicate further opportunities for purchases.
Data Security
We use reasonable and appropriate measures to protect your Personal Information from loss, misuse, unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the Personal Information.
Choice
We will give you an opportunity to choose whether your Personal Information may be used for a purpose that is materially different from the purposes for which it was originally collectsed or subsequently authorized by you, or if we intend to disclose it to a third party acting as a data controller that we have not previously disclosed to you. In such circumstances, we will notify you and offer you the opportunity to opt-out of such uses and/or disclosures where non-sensitive Personal Information is involved, and to opt-in where sensitive Personal Information is involved.
Access to Personal Information
Where appropriate, Replica Belts will provide you with access to the Personal Information that we maintain about you. We conduct an annual self-assessment of our Personal Information practices to verify that the attestations and assertions made in this Policy are true and have been implemented as represented.
In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Replica Belts commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF to JAMS, an alternative dispute resolution provider based in the United States. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://www.jamsadr.com/DPF-Dispute-Resolution for more information or to file a complaint. The services of JAMS are provided at no cost to you.
Under certain conditions, you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.
